Domicile or income certificate rejected or delayed in India — speaking order, state Public Services Guarantee / e-District appeal, RTI file trail, resubmission (2026)

Plain map when a domicile (residence) or income certificate is refused, marked deficient, or stuck beyond the citizen-charter timeline on a state e-District or revenue portal: get a written reasoned order, correct the source documents, use the statutory appeal or grievance route under your State’s Right to Public Services / Janhit Guarantee-type Act, and use RTI for the file trail — not to force issuance. Educational only — not legal advice; Adhiwakta does not apply for certificates or contact tehsils.

These are State services — not one central rule

Domicile / residence and income certificates are issued under State or Union Territory revenue and e-governance rules. Eligibility period, document list, fee, service timeline and appeal officer differ by State. Always download the checklist and timeline from your State’s official e-District / revenue portal (reachable via services.india.gov.in or the State site) on the day you apply. Do not rely on agent WhatsApp lists.

Step 1 — Save the acknowledgement and the exact rejection reason

Keep the application number, payment receipt, uploaded files and the portal message or letter. A rejection should be a speaking order — it must say what failed (wrong address proof, income definition, verification report, spelling mismatch, and so on). Courts have criticised one-line ‘lack of evidence’ website notes that never reach the applicant as a proper order, because you cannot appeal without reasons. Ask the tehsil / SDM office in writing for a copy of the reasoned decision and the verification report.

Step 2 — Fix the source record, then resubmit the allowed way

Correct the underlying problem (legible salary certificate, updated Aadhaar address, school leaving certificate, ration card entry, affidavit where the rule allows) instead of filing the same defective application again and again. Use the portal’s correction / resubmission path if it exists; otherwise file a fresh application only after the deficiency is cured. Keep every new acknowledgement.

Step 3 — Public Services Guarantee / citizen-charter appeal

Most States notify these certificates as guaranteed public services with a time limit (often about 7–15 working days, but quote only your State’s notified period). Under Right to Public Services / Janhit Guarantee-type Acts, delay or wrongful refusal can be escalated to a first appellate officer and then a second appellate / commission, sometimes with a small penalty on the defaulting officer. File within the period printed on the acknowledgement or Act. Examples of framing differ — e.g. Uttar Pradesh’s Janhit Guarantee Adhiniyam, 2011 treats notified caste, income and domicile certificates as guaranteed services — always read your own State’s current notification.

Step 4 — RTI for the file trail (not for forcing the certificate)

Under the Right to Information Act, 2005, ask the PIO of the tehsil / SDM office for: status of application number X; rule or checklist applied; scrutiny and field-verification report; file movement with dates and officers; and a certified copy of the reasoned rejection. The PIO must reply in 30 days (Section 7). Silence is a deemed refusal — First Appeal under Section 19(1), then Second Appeal to the State Information Commission under Section 19(3). RTI cannot order the tehsildar to certify your income or domicile; use it for records while the service appeal runs in parallel. See also our RTI basics and first-appeal guides.

Overlap with caste / EWS certificates

Caste and EWS certificates often travel the same revenue pipeline. If your refusal is about category or creamy-layer income for EWS, read our caste / EWS certificate dispute guide as well. Do not mix three different certificate types in one confused application.

Papers to keep

Portal acknowledgements; rejection / deficiency note; salary slips or employer certificate / ITR / Form 16 as your State lists; proof of continuous residence; ID and address proofs; copies of every grievance and RTI with postal or portal receipts; and a one-page timeline of dates.

What this guide is not

It is not a promise that any certificate will issue by a scholarship deadline, not advice to pay middlemen, and not a national checklist that overrides your State’s current rule.

Frequently asked questions

My income or domicile certificate was rejected — what first?
Download or demand the written speaking order and verification report, fix the exact deficiency in your source documents, then use the portal’s resubmission or your State’s Public Services Guarantee appeal route.
Can RTI force the tehsildar to issue the certificate?
No. RTI obtains existing records (status, reports, reasons, file movement). Issuance follows the service rules and appeal process, not an RTI direction.
How long should the certificate take?
There is no single national deadline. Quote only the timeline notified for that service on your State e-District / citizen-charter page (often about 7–15 working days, but verify locally).
Where do I appeal a wrongful rejection?
Use the first appellate officer named in your State’s Right to Public Services / Janhit Guarantee-type Act or on the acknowledgement, then the next appellate level. Parallel RTI First Appeal is for information delay, not for substituting the certificate appeal.
Does Adhiwakta apply for certificates?
No. We do not file e-District applications or contact revenue offices. Use Ask Adhiwakta or the AI helper for general educational guidance only.
