BETWEEN

AND

[Tenant's name], S/o [father's/husband's name], permanently residing at [tenant's permanent address], hereinafter called the "LICENSEE" (occupant), which expression shall include his/her heirs and legal representatives, of the OTHER PART.

WHEREAS the Licensor is the owner of, or otherwise lawfully entitled to give on licence, the premises described in the Schedule below ("the Premises"); the Licensee has requested the Licensor to permit the use of the Premises for residential purposes on leave and licence basis; and the Licensor has agreed on the terms below.

NOW THIS AGREEMENT WITNESSES AND THE PARTIES AGREE AS FOLLOWS:

1. Period: The Licensor grants the Licensee leave and licence to use and occupy the Premises for a period of 11 months, commencing on [start date] and ending on [end date], unless terminated earlier as provided below.

2. Licence fee (rent): The Licensee shall pay a monthly licence fee of ₹[amount] (Rupees [in words] only), in advance, on or before the 5th day of each English calendar month, by bank transfer / UPI / cheque. The Licensor shall acknowledge each payment by a receipt or written message.

3. Security deposit: The Licensee has paid to the Licensor an interest-free, refundable security deposit of ₹[amount] (Rupees [in words] only), which the Licensor acknowledges. It shall be refunded when the Licensee hands over vacant and peaceful possession of the Premises, after deducting only lawful dues such as unpaid licence fee, unpaid utility bills and the reasonable cost of repairing damage beyond normal wear and tear.

4. Charges: Electricity and water charges as per actual consumption / meter shall be paid by the Licensee directly to the authority concerned. Society / maintenance charges shall be paid by the Licensee. Property tax and other levies on the owner shall be paid by the Licensor.

5. Use: The Premises shall be used only for residential purposes by the Licensee and his/her family members. The Licensee shall not sub-let, assign, transfer or otherwise part with possession of the whole or any part of the Premises, shall not use it for any illegal, immoral or commercial activity, and shall follow the rules of the society / building.

6. Repairs and alterations: Minor day-to-day repairs (such as fuses, bulbs, taps and minor plumbing) shall be done by the Licensee at his/her cost. Major and structural repairs shall be the responsibility of the Licensor. The Licensee shall not make any structural addition or alteration without the prior written consent of the Licensor.

7. Inspection: The Licensor or his/her authorised person may inspect the Premises at a reasonable time after giving reasonable prior notice to the Licensee.

8. Termination: Either party may terminate this Agreement by giving 1 month's notice in writing to the other. If the Licensee fails to pay the licence fee for two consecutive months or breaches any material term, the Licensor may terminate this Agreement by written notice.

9. Handing over: On expiry or earlier termination, the Licensee shall hand over vacant and peaceful possession of the Premises to the Licensor in the same condition as received, subject to normal wear and tear, together with the fittings listed in the Schedule and all keys.

10. Renewal: This Agreement may be renewed only by mutual consent, by a fresh written agreement on the terms then agreed between the parties.

11. Nature of agreement: This is a leave and licence arrangement. The parties intend that it does not create any tenancy, lease or other interest in the Premises in favour of the Licensee, beyond the permission to use stated in this Agreement.

12. Verification: The Licensee shall give copies of identity and address proof to the Licensor, and the parties shall complete tenant / police verification wherever required by the local authorities.

13. Stamp duty and registration: Stamp duty and registration charges, if any, as applicable in the State shall be borne by the Licensee.

Notes before use (stamp duty and registration vary by State):

  • Print on non-judicial stamp paper / e-stamp paper of the value required by your State's Stamp Act (or pay the duty as your State allows). An unstamped or under-stamped agreement can face problems when it is relied on as evidence.
  • Registration: a lease for more than one year (or from year to year) must be registered under Section 17 of the Registration Act, 1908. Some States require registration of leave and licence agreements of any period (for example, Maharashtra), and States that have adopted the Model Tenancy Act may require the agreement to be reported to the Rent Authority. Check the rule in your State.
  • Rent control and tenancy laws differ by State; a court looks at the real nature of the arrangement, not only its title.

Frequently asked questions

Why are most rent agreements made for 11 months?
Under Section 17 of the Registration Act, 1908, a lease for more than one year (or from year to year) must be registered. An 11-month agreement is commonly used to stay below that threshold. It still needs stamp duty under your State's law, and some States (for example Maharashtra) require leave and licence agreements of any period to be registered.
What is a leave and licence agreement?
It is a permission to use premises for a fixed period without transferring an interest in the property, unlike a lease. Courts look at the real arrangement, not just the title, and tenancy laws differ by State — so get the final draft checked by an advocate.
How much stamp duty is payable on a rent agreement?
It depends on your State's Stamp Act and is often calculated on the rent and deposit for the period. Check the current rate with your State's registration / e-stamp portal or an advocate before printing.
Is this rent agreement format free?
Yes. It runs entirely in your browser; nothing you type is uploaded or stored by Adhiwakta.
