When registration can be cancelled (Section 29)
A registered person may apply to cancel registration (for example on closure of business or transfer). Separately, the proper officer may cancel registration on their own motion under Section 29(2) CGST Act for grounds such as not conducting business from the declared place, issuing invoices without supply, or not furnishing returns for the continuous period prescribed (rules have treated sustained non-filing as a ground making registration liable to cancellation). Cancellation under CGST is generally treated as cancellation under SGST/UTGST and vice versa. Status often shows as ‘Suspended’ while proceedings are open.
Suo moto path — notice, reply, reasoned order
Before suo moto cancellation, the officer issues a show-cause notice (commonly FORM GST REG-17). You typically get a short window (often described on the portal as about seven working days) to file clarifications. If the reply is satisfactory — and, for return-default themes, if pending returns are filed and tax, interest, penalty and late fee are paid — Rule 22(4) requires proceedings to be dropped (REG-20). If cancellation proceeds, the order is in FORM GST REG-19 with an effective date (which can be retrospective where the law allows). Courts have stressed that cancellation needs a reasoned order, not a bare checkbox — keep screenshots of the SCN, reply, and order.

Revocation of cancellation (Section 30 / Rule 23)
Where the proper officer cancelled registration on their own motion, Section 30 lets you seek revocation. Rule 23: apply in FORM GST REG-21 on the GST portal within ninety days of service of the cancellation order (subject to Rule 10B Aadhaar authentication themes where applicable). Official portal guidance commonly allows filing between days 91–270 with a condonation-of-delay request routed to a competent authority; after about 270 days the portal message points you to appeal before the Appellate Authority instead of REG-21. If inclined to allow revocation, the officer issues REG-22; before rejecting, a REG-23 notice and REG-24 reply are used.
Appeal under Section 107 CGST
Any person aggrieved by a decision or order of an adjudicating authority may appeal to the prescribed Appellate Authority within three months of communication of the order (Section 107(1)). The Appellate Authority may condone a further one month if sufficient cause is shown (s. 107(4)). Pre-deposit and form requirements (including APL-01 on the portal) apply as prescribed — confirm the current portal checklist and any notified fee/pre-deposit before filing. A further appeal to the GST Appellate Tribunal (GSTAT) under Section 112 is a later stage against Appellate/Revisional Authority orders, with its own limitation and pre-deposit rules — not the first step after REG-19.
Practical documents and portal habits
Save REG-17/19/21 PDFs, ARN acknowledgements, return filing proofs (GSTR-1/3B or whatever was pending), challan/payment proofs, bank statements, rent/ownership proof of the principal place of business, and a clear chronology. File from the same credentials that own the GSTIN. Do not ignore SCNs hoping the suspension will reverse itself.
What this guide is not
It is not a substitute for a chartered accountant or GST practitioner on liability computation, input-tax-credit exposure after cancellation, or State-specific circulars. High Court writs are a separate, exceptional path when natural-justice or jurisdictional errors are alleged — strategy is fact-specific.

Frequently asked questions
- What is the first step after a GST cancellation SCN?
- File a timely reply/clarification to the REG-17 (or similar) show-cause notice on the GST portal, with returns and payment proofs if the allegation is non-filing. Keep ARN and PDF copies.
- How long do I have to apply for revocation (REG-21)?
- Rule 23 generally allows FORM GST REG-21 within ninety days of service of the suo moto cancellation order. Portal practice commonly discusses a further condonation window (often up to about 270 days); after that, the portal points to appeal. Confirm the live portal message for your GSTIN.
- What is a Section 107 GST appeal?
- An appeal to the Appellate Authority against an adjudicating authority’s order, ordinarily within three months of communication, with a possible further one-month condonation for sufficient cause. Pre-deposit and APL-01 formalities apply as prescribed.
- Is GSTAT the first remedy after REG-19?
- Usually no. Revocation (REG-21) and/or Section 107 appeal to the Appellate Authority come first. GSTAT under Section 112 is typically against Appellate or Revisional Authority orders.
- Does Adhiwakta file GST revocation or appeals?
- No. We do not file portal forms or appear in GST proceedings. Use Ask Adhiwakta or the AI helper for general educational guidance only.
