Legal heir certificate in India — vs succession certificate, documents, how to apply (state process)

What a legal heir (or surviving member) certificate is used for in India — family pension, PF/gratuity support, mutation/khata support, utilities — how it differs from a succession certificate under the Indian Succession Act, 1925, typical documents, and that the process is state-specific (tahsildar / e-district portals). What a legal heir certificate is (and is not)

A legal heir certificate (sometimes called a surviving member certificate or heirship certificate in local practice) is usually issued by the local revenue authority — often the tahsildar, revenue officer, or an e-district / citizen-service portal — after a death. It lists the surviving legal heirs for administrative purposes: supporting family pension or gratuity claims, helping with PF / EPFO paperwork, mutation or khata/property tax record updates, and changing utility or bank nominations where the institution accepts it. It is generally not a court decree that finally decides ownership shares or title to property. Personal law, a will, or a civil suit may still control who owns what.

Legal heir certificate vs succession certificate

These are often confused. A succession certificate is a civil-court document under the Indian Succession Act, 1925 (Part X, roughly Sections 370–390; the petition is commonly under Section 372). It is mainly for collecting debts and securities of the deceased — bank deposits, shares, government securities — and gives the holder a measure of discharge protection when debtors pay. It usually involves court fees linked to the value of the assets, notice to heirs, and more time. A legal heir certificate is typically a revenue / local-administration document for day-to-day claims and record updates. Banks and employers may ask for one or the other (or both) depending on the asset and their rules — always check what the institution has written in its letter.

How it differs from probate, letters of administration, and a will

If the deceased left a valid will, probate or letters of administration may come into play for proving the will or administering the estate (rules vary by personal law and facts; probate is no longer compulsory in the old Presidency towns after Section 213 of the Succession Act was omitted in late 2025, but institutions may still ask for court papers in contested cases). A will directs who gets what; a legal heir certificate does not rewrite a will. For a plain overview of wills, see our will-registration guide; for debts and securities through court, see succession-certificate basics.

Who usually applies, and where

A surviving spouse, adult child, or another close heir commonly applies in the district or tehsil where the deceased last resided or where the property/claim is relevant. The exact office and online portal are state-specific: many states use e-district, Seva Sindhu, e-Sevai, Aaple Sarkar, or similar MeeSeva-style counters. Some municipalities or employers have their own heirship formats. There is no single all-India form or fee — do not rely on one state’s fee table as universal. Check your state’s official portal or the local tahsildar / revenue office notice board.

Papers people usually organise

Death certificate of the deceased; applicant’s identity and address proof; proof of relationship (ration card, family register, birth/marriage certificates, Aadhaar as accepted locally); an affidavit or self-declaration listing all legal heirs; sometimes a No Objection Certificate (NOC) or consent from other heirs; photographs; and any pension / PF / property survey or khata details the form asks for. Keep photocopies and note application / acknowledgement numbers. False statements in affidavits can lead to legal consequences — stick to facts.

Typical process outline (state process varies)

In many places the steps look like: fill the online or offline form → attach documents → pay the state-prescribed fee if any → local enquiry or notice to other heirs → certificate issued under the tahsildar / competent authority’s signature or digital seal. Timelines differ widely by district. If other heirs object, or if there is a will dispute or rival claim, the revenue office may refuse or pause, and a civil court path may be needed. Mutation of land records is a separate application even when you already have a legal heir certificate.

When a succession certificate (or court route) may still be needed

Large bank balances, demat shares, or institutions that insist on a court succession certificate; contested heirship; or when you need formal discharge protection for a debtor paying the representative. A legal heir certificate alone may not unlock every asset. An independent advocate can help you match the document to the asset list — Adhiwakta does not decide that for you.

Frequently asked questions

Is a legal heir certificate the same as a succession certificate?
No. A legal heir certificate is usually issued by the revenue / tahsildar or e-district authority to identify surviving heirs for pension, PF, mutation support, and similar admin uses. A succession certificate is a civil-court document under the Indian Succession Act, 1925 (petition often under Section 372) mainly for debts and securities such as bank deposits and shares.
Does a legal heir certificate prove my share in the property?
Generally no. It supports administrative identification of heirs; it is not usually a final court determination of title or exact shares. Ownership may still depend on personal law, a will, mutation, or a civil decree.
Will Adhiwakta apply for my legal heir certificate?
No. Adhiwakta is a facilitation platform, not a filing bureau. We do not apply to tahsildars or courts for you and cannot guarantee any certificate, pension, PF, or mutation result. You can Ask Adhiwakta for general guidance from an independent advocate.
