Adults have the right to marry by choice

The Supreme Court has repeatedly held that adults can marry a person of their choice and that families, khap panchayats or the community cannot stop them. In Lata Singh v. State of U.P. (2006) the Court said police must act against anyone who threatens or harms such couples. In Shafin Jahan (2018) it held the right to choose a partner is part of Article 21, and in Laxmibai Chandaragi (2021) it said the consent of the family or community is not needed once two adults agree.

Check age and validity first

The legal age to marry is 21 for the man and 18 for the woman (Hindu Marriage Act s.5(iii); Special Marriage Act s.4; Prohibition of Child Marriage Act, 2006). Neither should have a living spouse. Keep age proof (school certificate, Aadhaar, birth certificate). A Hindu marriage needs the customary ceremonies (HMA s.7) and can then be registered (s.8). An inter-religion couple who do not want to convert can marry under the Special Marriage Act, 1954 before the Marriage Officer after a 30-day notice (ss.5–7). Registering the marriage gives strong proof — rely on a Registrar’s certificate rather than only a temple or society certificate.

Inter-faith marriage with conversion — State laws

Several States have anti-conversion laws that require a prior declaration to the District Magistrate before conversion and can treat a marriage done only for unlawful conversion as void — for example the U.P. Prohibition of Unlawful Conversion of Religion Act, 2021, with similar laws in Uttarakhand, Madhya Pradesh, Gujarat, Himachal Pradesh, Karnataka and Haryana. The Special Marriage Act route does not need conversion. On the SMA 30-day notice, the Allahabad High Court (Safiya Sultana, 2021) held publication can be optional at the couple’s request in Uttar Pradesh; practice differs by State.

Facing threats — ask the police and the SP in writing

Write a short application to the SHO and the Superintendent of Police / Commissioner: your names, ages (attach proof), marriage or intention to marry, who is threatening you, how (calls, messages, visits), and a request for protection. Send it by email and Speed Post and keep copies. In Shakti Vahini v. Union of India (27 March 2018) the Supreme Court directed police to register an FIR on threats, have an officer of ASP rank enquire into the threat within a week, provide security, and if needed move the couple to a safe house; States were asked to set up safe houses at district headquarters, where couples may stay initially for a month, extendable up to one year depending on the threat. Threats are offences such as criminal intimidation (BNS s.351, old IPC 506).

High Court protection petition

If police do not respond or the threat is serious, couples commonly file a writ petition in the High Court under Article 226 asking for directions to the police to protect their life and liberty. High Courts regularly hear such petitions, often quickly. Courts usually look at age proof, marriage proof or the couple’s statement, and the threat material. A protection order is about safety; it does not by itself decide whether the marriage is valid.

If parents file a kidnapping or ‘missing’ FIR

Families sometimes file a kidnapping FIR against the boy. If the woman is an adult and left by choice, she can appear before the police or the Magistrate and give a statement that she went of her own free will (a Magistrate statement under BNSS s.183, old CrPC 164, carries weight). Courts have quashed such FIRs where an adult woman married voluntarily. If either partner is under 18, the situation is very different — the POCSO Act and child-marriage law can apply — so take guidance urgently.

Practical safety steps

Keep copies of age proof, marriage certificate, photos and threat messages in your phone and email. Share your location with a trusted friend, keep the local SP / women helpline numbers (112, 181) ready, and avoid meeting angry relatives alone. Do not post provocative content online. If you are a government or private employee, keep your workplace informed only as needed for safety.

Frequently asked questions

Can adults marry without their parents’ consent in India?
Yes. If the man is 21+ and the woman 18+, neither has a living spouse, and the legal conditions are met, parental or community consent is not needed (Lata Singh 2006; Laxmibai Chandaragi 2021).
How do we get police protection for a love marriage?
Give a written application with age and marriage proof and the threat details to the SHO and the SP / Commissioner. Under Shakti Vahini (2018) police must enquire into threats, register FIRs and provide protection, including a safe house where available.
What is a protection petition in the High Court?
A writ petition under Article 226 asking the court to direct police to protect the couple’s life and liberty. It is commonly used when police do not respond or the threat is serious.
Parents filed a kidnapping case against my husband. What can I do?
If you are an adult and married or left by choice, you can give a statement to police or before a Magistrate (BNSS s.183, old CrPC 164) that you went voluntarily. Courts have quashed such FIRs in suitable cases.
Is court marriage possible for an inter-religion couple without conversion?
Yes, under the Special Marriage Act, 1954 before the Marriage Officer after a 30-day notice. No conversion is needed.
Is an Arya Samaj or temple certificate enough?
A ceremony certificate alone may be questioned. Registering the marriage with the Registrar (HMA s.8 / State rules, or under the Special Marriage Act) gives stronger proof.
