NRI power of attorney for property in India — how to make it abroad: specific vs general POA, notary + Apostille or Indian embassy attestation, stamp duty within three months of arrival (Stamp Act s.18), registration, revocation and fraud safety (2026)

Plain step-by-step guide for NRIs and OCIs who live abroad and want a relative or trusted person in India to sell, buy, rent, register or look after property: which kind of power of attorney to choose, how to sign it abroad (notary and Apostille, or the Indian embassy), the three-month stamp-duty rule after it reaches India, when registration is needed, how to cancel it, and how to avoid misuse. First — decide exactly what the POA must do

A power of attorney lets your agent (the ‘attorney’) act in your name. A specific POA is limited to named tasks — for example, sell flat no. X in a named building, sign the sale deed and receive the price into your NRO account. A general POA covers many matters and is riskier. Write the property description, the powers (sign, present for registration, receive money, deal with society, tax or court) and how long it lasts. Ask for money to come only into your own bank account. Never give a blank or unlimited POA to someone you have not fully checked.

A POA is not a sale — avoid ‘GPA sales’

In Suraj Lamp & Industries v. State of Haryana (2011), the Supreme Court held that ‘sales’ by sale agreement, general power of attorney and Will do not transfer ownership of immovable property; ownership passes only by a registered sale deed. So a POA should be used to sign and register a proper deed, not as a substitute for one. Also, an NRI or OCI cannot buy agricultural land, a plantation or a farmhouse in India (except by inheritance) under the FEMA rules, so check this before buying through an agent.

Step 1 — Sign it abroad: Apostille or embassy

Draft the POA (many Indian sub-registrars and banks prefer English, with the property schedule). Sign it in the presence of a notary in your country. If that country is a member of the Hague Apostille Convention, get an Apostille from its designated authority; India has been a member since 2005, and the Ministry of External Affairs says an apostilled document needs no further legalisation for use in India. If the country is not a member, get the POA attested by the Indian embassy or consulate (many missions do this through an outsourced service centre). Under section 33 of the Registration Act, 1908, a POA executed abroad and authenticated by a notary, court, magistrate or Indian consul is recognised for presenting documents for registration. Check your mission’s and your State’s current requirements before you sign — photos, witnesses and ID copies are often needed.

Step 2 — Stamp duty within three months of arrival

A POA executed outside India must be stamped within three months after it is first received in India (Indian Stamp Act, 1899, section 18; States have similar rules). Your attorney takes the original to the Collector of Stamps / sub-registrar office, pays the State’s stamp duty and gets it adjudicated or endorsed. An unstamped instrument cannot be acted upon or registered (section 35); late stamping usually means a penalty. Note the date the courier arrives in India and keep the courier record.

Step 3 — Registration and use

Some States require a POA for selling or transferring immovable property to be registered, and sub-registrars often insist on it. Check the rule in the State where the property is. When the attorney signs the sale deed, the sub-registrar will usually ask for the original POA, the adjudication, your ID copies and sometimes a recent ‘life certificate’ or affidavit that you are alive and the POA is not cancelled — because a POA ends when the principal dies. Tax and FEMA rules apply to the sale money and repatriation; take advice from a chartered accountant.

Cancelling a POA

You can revoke a POA by a revocation deed signed the same way (notary + Apostille or embassy), and, where the POA was registered, by registering the revocation. Send written notice of revocation to the attorney, the sub-registrar, the bank, the society and any buyer you know of — under the Contract Act (sections 201 and 203) a POA ends on revocation or the principal’s death, but people who did not know of the revocation may still be protected for acts done before they learnt of it. A POA given along with an interest of the attorney in the property can be irrevocable (section 202).

Protect yourself from misuse

Prefer a specific POA with a fixed end date. Ask for copies of every document the attorney signs, and check encumbrance and land records online regularly. Keep the original property papers with you or in a safe place. If you suspect forgery or misuse, act fast — revoke the POA, inform the sub-registrar and bank, and see our guides on cancelling a fraudulent sale deed and on cheating cases.

Frequently asked questions

Do I need the Indian embassy to attest my POA if I live in the USA or UK?
Usually not. If the country is a member of the Hague Apostille Convention, a notarised POA with an Apostille is accepted in India without further legalisation, as the Ministry of External Affairs says. In non-member countries, use the Indian embassy or consulate.
What is the time limit to stamp a POA sent from abroad?
Three months from when it is first received in India (Indian Stamp Act section 18 and similar State rules). After that a penalty usually applies, and an unstamped POA cannot be used.
Can my brother sell my flat in India using a general power of attorney?
He can sign and register a proper sale deed if the POA gives that power. But a ‘GPA sale’ without a registered sale deed does not transfer ownership (Suraj Lamp & Industries, 2011). A specific POA for that one property is safer.
How do I cancel a power of attorney from abroad?
Sign a revocation deed with notary and Apostille or embassy attestation, register it where the POA was registered, and send notice to the attorney, sub-registrar and bank. A POA also ends automatically on the principal’s death.
Can an NRI buy agricultural land through a POA holder?
No. Under the FEMA rules, NRIs and OCIs cannot acquire agricultural land, plantation property or a farmhouse in India except by inheritance. Other residential or commercial property is generally allowed.
