FAQs
- What is Buzurg Adhikar?
- A bilingual tool for senior citizens, parents and their families in India. Pick one of 7 problems (no maintenance from children, property given to a child and no care, harassed or thrown out of your own house, an elderly person abandoned, pension stopped / life certificate, cheated by a call or 'digital arrest', planning a will and nominees) to see the first 3 steps, rights in short, proof to keep, what not to do, where to go, a ready application / letter and a WhatsApp Status card. Educational facilitation only — not legal advice.
- Do I need a lawyer at the Maintenance Tribunal?
- No. Under s.17 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, no party can be represented by a legal practitioner before the Maintenance Tribunal. You can apply yourself, or a family member / registered organisation can help you file. Government legal aid (15100) can also guide you.
- How much maintenance can the Tribunal order?
- Up to ₹10,000 per month, as your State prescribes (s.9(2)). Maintenance covers food, clothing, residence, medical care and treatment. The Tribunal should decide within 90 days of notice (extendable once by 30 days). A separate route under BNSS s.144 (old CrPC s.125) before the Magistrate has no fixed cap, but you cannot use both for the same claim.
- Can I take back property I gave to my son or daughter?
- Under s.23(1) of the 2007 Act, if after the Act you transferred property on the condition that the child would provide basic amenities and physical needs, and the child refuses or fails to do so, the Tribunal can declare the transfer void at your option. Courts have differed on how clearly the condition must appear in the deed; in 2025 (Urmila Dixit) the Supreme Court took a beneficial view. Results depend on facts — keep the deed and proof of the promise.
- Is anything I type sent or stored?
- No. The application / letter is built in your browser. You copy it, print it or open WhatsApp / email and send it yourself. Adhiwakta does not see, store or send it.
