LEAVE AND LICENCE / RENT AGREEMENT

(To be printed on stamp paper / e-stamp)

This Leave and Licence / Rent Agreement is made at __________ on this __________ day of __________, between:

1. __________, residing at __________ (hereinafter "the Licensor / Landlord"), of the First Part; and

2. __________, residing at __________ (hereinafter "the Licensee / Tenant"), of the Second Part.

The Landlord is the owner / lawful occupant of the premises at __________ ("the Premises"). The Tenant has requested temporary use of the Premises for residential purposes only, and the Landlord has agreed on the following terms:

1. Term

This agreement is for 11 months, from __________ to __________. It may be renewed only by a fresh written agreement signed by both parties.

2. Rent

The monthly rent is ₹__________, payable in advance on or before the 5th day of each month by bank transfer / UPI / cheque. For any cash payment the Landlord shall give a signed receipt.

On renewal, the rent shall increase by 5% over the last rent, unless both parties agree otherwise in writing.

3. Security deposit

The Tenant has paid an interest-free security deposit of ₹__________. The Landlord shall refund it within 15 days of the Tenant vacating and handing over the keys, after deducting only unpaid rent / bills and the cost of damage beyond normal wear and tear, with a written account of any deduction.

4. Electricity, water and maintenance

Electricity charges shall be paid by the Licensee (Tenant) as per actual bills, on time.

Water charges shall be paid by the Licensee (Tenant) as per actual bills, on time.

Society maintenance charges shall be paid by the Licensor (Landlord).

At the end of the term the Tenant shall clear final bills and show the receipts.

5. Repairs and upkeep

The Tenant shall keep the Premises clean and in good condition. Minor day-to-day repairs (bulbs, tap washers, etc.) shall be done by the Tenant; major / structural repairs (roof leakage, wiring, plumbing lines) shall be done by the Landlord.

The Tenant shall not make any structural change without the Landlord's written consent.

6. No subletting

The Tenant shall not sublet, assign or part with possession of the Premises or any part of it, and shall not keep paying guests.

7. Use and rules

The Premises shall be used only for residence and not for any illegal, unlawful or nuisance-causing activity. The Tenant shall follow the society / building rules.

8. Police verification

The Tenant shall provide identity proof and photographs. The Landlord shall get tenant verification done with the local police / the State's online portal, and the Tenant shall co-operate.

9. Inspection

The Landlord or an authorised person may inspect the Premises at a reasonable time after reasonable prior notice.

10. Termination and notice

There is no lock-in period in this agreement.

Either party may terminate this agreement by giving 1 month(s) written notice.

If rent is not paid for two consecutive months, or on a serious breach of these terms, the Landlord may terminate this agreement by notice.

On expiry or termination, the Tenant shall peacefully vacate and hand over the Premises and keys in the same condition, subject to normal wear and tear.

11. Fixtures and furnishings

The Premises are given unfurnished.

12. Nature of agreement

This is a leave and licence only. It does not create any tenancy right, interest or ownership in the Premises in favour of the Tenant beyond what applicable law provides.

13. Disputes and jurisdiction

The parties shall first try to settle any dispute by discussion. Failing that, only the courts where the Premises are situated shall have jurisdiction, and the applicable State rent law shall apply.

14. Stamp duty and costs

This agreement shall be executed on stamp paper / e-stamp of the value applicable in the State. Stamp duty and registration charges (if any) shall be borne by __________.

Why 11 months?

Most rent agreements are made for 11 months because leases from year to year or for more than one year must be registered (Registration Act, 1908 s.17(1)(d); Transfer of Property Act s.107). Above 11 months, plan for registration at the Sub-Registrar office.

Stamp duty varies by State

Stamp duty and registration fee are fixed by each State and often depend on rent, deposit and duration. Check your State's current rates on the official stamp / registration department website before buying stamp paper.

E-stamp option

Many States issue e-stamp certificates (for example via SHCIL or the State portal). An e-stamp is easier to verify than old paper stamps. Print the agreement on it or attach it as the first page, as your State allows.

Some States need registration for every agreement

In Maharashtra, every leave-and-licence agreement must be registered (Maharashtra Rent Control Act, 1999 s.55), often done online. Check your State's rule.

Police tenant verification

Most cities require the landlord to get the tenant verified with the local police — usually online on the State police portal or at the police station, with ID proof and photos.

Sign properly

Both parties sign every page, with two witnesses. Keep ID copies, rent receipts / UPI records, and a photo list of items handed over.

Why is the default 11 months?

Leases from year to year or for more than one year must be registered under the Registration Act, 1908 s.17(1)(d). An 11-month leave-and-licence is common to keep it simple, but stamp duty still applies, and some States (like Maharashtra) need registration for every agreement.
