FAQs

Will I get into trouble if I help a road accident victim?
No. Section 134A of the Motor Vehicles Act protects a Good Samaritan who helps in good faith from civil or criminal liability. Under the 2020 Good Samaritan Rules you may leave the hospital at once, nobody can force you to give your name or phone, the hospital cannot ask you to pay, and the police cannot compel you to be a witness.
Is there cashless treatment for road accident victims?
Yes. Under PM-RAHAT (the Cashless Treatment of Road Accident Victims Scheme, 2025, renamed in February 2026), any road accident victim can get cashless treatment up to ₹1.5 lakh for up to 7 days from the accident at designated hospitals, including in hit-and-run cases, subject to police confirmation on the online system. Call 112 to find the nearest designated hospital.
How much compensation is given in a hit-and-run case?
Under Section 161 of the Motor Vehicles Act and the 2022 Scheme, a fixed ₹2,00,000 for death and ₹50,000 for grievous hurt, applied for in Form I to the Claims Enquiry Officer of the area. If the vehicle is traced later, a full claim before the MACT is possible.
What is the time limit for a motor accident (MACT) claim?
Section 166(3) of the Motor Vehicles Act says six months from the accident. The limit is under challenge in the Supreme Court, but it is safest to file early. The police's Detailed Accident Report is also treated as a claim application.
Does Adhiwakta file the FIR or the compensation claim?
No. Adhiwakta is a legal-help facilitation platform, not a law firm. It does not file reports or claims for you or guarantee any outcome. You can ask a general question on WhatsApp.
