Before you file

Complain to the seller or service provider in writing and keep the ticket numbers. For e-commerce purchases, write to the platform’s grievance officer (required under the Consumer Protection (E-Commerce) Rules, 2020). You can also try the National Consumer Helpline — call 1915 or use the NCH app / consumerhelpline.gov.in — which often resolves complaints before litigation. A legal notice is not compulsory but can help (see our free legal notice generator).

e-Daakhil is now e-Jagriti

On 1 January 2025 the Department of Consumer Affairs launched e-Jagriti, a single platform that merged e-Daakhil, OCMS, CONFONET and the NCDRC case system. It works for the National Commission and all 36 States/UTs: register with an OTP, file from anywhere, pay fees online, and track your case. Old e-Daakhil cases were migrated. Filing on paper at the Commission’s counter is still allowed.

Which Consumer Commission?

It depends on the value of the goods or services you paid for (Consumer Protection (Jurisdiction) Rules, 2021): District Commission — up to ₹50 lakh; State Commission — above ₹50 lakh up to ₹2 crore; National Commission — above ₹2 crore. You can file where the opposite party lives or works, where the cause of action arose, or where you live or personally work (Section 34(2), Consumer Protection Act, 2019).

Fees and time limit

There is no filing fee for complaints where the consideration paid is up to ₹5 lakh; above that, a modest slab fee applies and the portal shows the exact amount. You must file within 2 years from the date the cause of action arose (Section 69); a later complaint needs a delay-condonation request with sufficient cause.

Steps on e-Jagriti

1) Register and log in with OTP. 2) Choose to file a new complaint, then select the commission, state and district. 3) Enter your details and the opposite party’s (use the company’s registered office address). 4) Describe the facts in date order, the defect or deficiency, and the relief — refund, replacement, repair, compensation and costs, with amounts. 5) Upload the complaint, a supporting affidavit, an index, and documents (invoice, warranty, emails/chats, photos, job cards). 6) Pay the fee if any and submit. 7) Track the case number and hearing dates; some hearings happen by video.

What the Commission can order

It can order the trader or service provider to remove the defect, replace the goods, refund the price, pay compensation and costs, or stop an unfair trade practice (Section 39). The Act aims to decide admissibility within 21 days and to decide complaints within 3 months (5 months if lab testing is needed), though real timelines are often longer.

Do you need a lawyer?

No — consumers can file and argue their own complaints. For complex or high-value cases, many people take an advocate’s help with drafting and evidence.

Adhiwakta is a facilitation platform, not a law firm; we do not file cases and cannot guarantee any refund or order. Use Ask Adhiwakta (Consumer) for general guidance from an independent advocate, or draft a notice with our free legal notice generator.
