Why the birth certificate matters even more now

The Registration of Births and Deaths (Amendment) Act, 2023 came into force on 1 October 2023. For a person born on or after that date, Section 17 of the amended Act makes the birth certificate the document to prove date and place of birth for purposes such as school admission, driving licence, voter list, marriage registration, government jobs, passport and Aadhaar. For people born earlier, departments still accept other documents under their own rules. Registration is also now done electronically into a national and State database.

Who registers a birth, and the normal time limit

For a birth in a hospital or health centre, the medical officer in charge must report it; for a home birth, usually the head of the household; other persons are listed in Section 8. The report must reach the local Registrar (municipal body, panchayat or as notified) within the period fixed by the rules — 21 days in most States. Many States use the Civil Registration System portal (crsorgi.gov.in) or their own portal. After registration, the Registrar must give the informant a certificate free of charge, electronically or otherwise, within seven days (Section 12).

Late registration — the three-step ladder (Section 13)

(1) Information given after the normal period but within 30 days: registered on payment of a late fee. (2) After 30 days but within one year: registered only with the written permission of the District Registrar (or other prescribed authority), with a fee and a self-attested document as prescribed. (3) After one year: registered only on an order of the District Magistrate, Sub-Divisional Magistrate or an Executive Magistrate authorised by the District Magistrate, after verifying that the birth really took place, and on payment of the fee. Before the 2023 amendment, step (3) needed an order of a first-class Magistrate; it now goes to the DM / SDM side. Fee amounts are set by State rules.

Documents commonly asked for in late registration

Practice varies by State and office, but applicants are usually asked for some of these: hospital discharge summary or birth record, an affidavit stating the date and place of birth, parents’ identity and address proof, school records, vaccination card, and a ‘non-availability’ report from the Registrar showing that no entry exists. Give true details only — false information is an offence under the Act.

Child’s name missing from the certificate (Section 14)

A birth can be registered without a name and the name added later. Under the Model Registration of Births and Deaths Rules, 1999 (Rule 10), the name can be given within 12 months of registration without fee, and after that, within 15 years of registration, on payment of a late fee. Some States have given time-bound extensions for older registrations — ask your Registrar whether one applies.

Correcting a mistake (Section 15)

If it is proved to the Registrar that an entry is wrong in form or substance, or was fraudulently or improperly made, the Registrar can correct it or cancel it by a note in the margin, without altering the original entry, following the State’s rules. Spelling mistakes and wrong parents’ names are common corrections; changes to the date of birth are examined much more strictly and need strong documentary proof. Keep copies of everything you submit.

If your application is refused or delayed — appeal (Section 25A)

The 2023 amendment added a statutory appeal. Against an action or order of the Registrar, appeal to the District Registrar; against the District Registrar, appeal to the Chief Registrar of the State — within 30 days of the action or of receiving the order. The appellate authority must decide within 90 days. An RTI application can help you find out the status of a pending file.

State differences and death certificates

Each State makes its own rules under the Act — fee amounts, forms, who acts as Registrar and District Registrar, and the online portal all differ. A death is registered the same way, and the same late-registration ladder in Section 13 applies to deaths. For property and succession work after a death, see also the legal heir and succession certificate guides.

What this guide is not

It does not tell you whether a particular late registration or correction will be allowed, or how long your office will take. Check your State’s current rules and portal.

Frequently asked questions

How do I get a birth certificate after one year?
Since the 2023 amendment, a birth reported after one year is registered only on an order of the District Magistrate, Sub-Divisional Magistrate or an authorised Executive Magistrate, after verification and payment of the fee (Section 13(3) of the RBD Act, 1969). Apply through your local Registrar or State portal.
What if the birth was not registered within 30 days?
Between 30 days and one year, registration needs the written permission of the District Registrar (or prescribed authority), a fee and a self-attested document (Section 13(2)). Within 30 days only a late fee applies.
Can the child’s name be added to the birth certificate later?
Yes. Under the Model Rules the name can be added within 12 months free, and after that within 15 years of registration with a late fee. Some States have given extensions for older registrations — ask the Registrar.
How do I correct a mistake in a birth certificate?
Apply to the Registrar with proof of the correct details. Under Section 15 the Registrar can correct an entry proved to be wrong by a marginal note, following State rules. Date-of-birth changes need strong documentary proof.
Can I appeal if the Registrar refuses?
Yes. Section 25A, added in 2023, allows an appeal to the District Registrar against the Registrar (and to the Chief Registrar against the District Registrar) within 30 days; it must be decided within 90 days.
Is a birth certificate now compulsory for school admission and passport?
For people born on or after 1 October 2023, the amended Act makes the birth certificate the proof of date and place of birth for purposes such as school admission, driving licence, voter list, marriage registration, government jobs, passport and Aadhaar. People born earlier can still use other documents accepted by each department.
Does Adhiwakta apply for birth certificates?
