Forward to your family group

In a hospital crisis, families rarely know that emergency care can't wait for police papers, that a body can't be held for a bill, or that records are due in 72 hours. Forward this to your family or society WhatsApp group before you need it.

FAQs

What is Mareez Adhikar?
A bilingual tool for patients and families in India. Pick one of 7 problems (emergency treatment refused, patient or body held over the bill, bill too high, medical records not given, wrong treatment / negligence, health insurance claim rejected, Ayushman card refused) to see the first 3 steps, rights in short, proof to keep, what not to do, where to go, a ready letter, a deadline clock and a WhatsApp Status card. General legal information facilitation only — not legal advice.
Can a hospital refuse emergency treatment until the police come or a deposit is paid?
No. In Pt. Parmanand Katara v Union of India (1989) the Supreme Court held that every doctor must give immediate aid to preserve life and that police or medico-legal formalities cannot delay it. Where the Clinical Establishments Act, 2010 applies, s.12(2) requires registered establishments to stabilise an emergency within their staff and facilities. Rape and acid-attack victims must get immediate free treatment in every hospital (BNSS s.397).
Can a hospital keep a dead body or stop discharge until the bill is paid?
The NHRC Charter of Patients' Rights (2019) says a patient cannot be detained on procedural grounds such as a payment dispute, and caretakers have the right to receive the body of a deceased patient. The hospital can recover a genuine bill through lawful means. If insured, the insurer must give final discharge authorisation within 3 hours and get the body released immediately if the patient died (IRDAI, 2024). In a standoff, call 112.
How fast must a hospital give medical records?
Under regulation 1.3.2 of the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002, records must be issued within 72 hours of a request by the patient, an authorised attendant or legal authorities; indoor records must be kept for 3 years. The NMC's 2023 regulations were held in abeyance in August 2023, so the 2002 rule applies.
Is anything I type sent or stored?
No. The letter and the deadline clock run in your browser. You copy, print or open WhatsApp / email and send it yourself. Adhiwakta does not see, store or send it.
